Obama Seeks Red Cross Help On War Crime Charges Against Bush, Cheney, Rumsfeld

Russian Foreign Ministry reports to President Medvedev are stating today that US Presidential candidate Barack Obama has sent one of his top aides named Valerie Jarrett to meet with officials from the International Committee of the Red Cross, in Geneva, Switzerland, to what is being described in these reports as the ‘preliminary stage’ to begin actions in the International Court of Justice charging the present United States President, Vice President and former US Defense Secretary with war crimes.

As we had previously written about in our October 15, 2005 report, the International Committee of the Red Cross opened in that year a War Crimes Portfolio alleging that President Bush, Vice President Cheney and Defense Secretary Rumsfeld, and other US Officials, were in violation of Articles 3 and 4 of the Geneva Convention and could be tried for Crimes Against Humanity.

These two Articles of the Geneva Convention state:

“Article 3

In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties, each party to the conflict shall be bound to apply, as a minimum, the following provisions:

1. Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, colour, religion or faith, sex, birth or wealth, or any other similar criteria.

To this end the following acts are and shall remain prohibited at any time and in any place whatsoever with respect to the above-mentioned persons:

(a) Violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;

(b) Taking of hostages;

(c) Outrages upon personal dignity, in particular, humiliating and degrading treatment;

(d) The passing of sentences and the carrying out of executions without previous judgment pronounced by a regularly constituted court affording all the judicial guarantees which are recognized as indispensable by civilized peoples.

2. The wounded and sick shall be collected and cared for.

An impartial humanitarian body, such as the International Committee of the Red Cross, may offer its services to the Parties to the conflict.

The Parties to the conflict should further endeavour to bring into force, by means of special agreements, all or part of the other provisions of the present Convention.

The application of the preceding provisions shall not affect the legal status of the Parties to the conflict.

Article 4

A. Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

1. Members of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.

2. Members of other militias and members of other volunteer corps, including those of organized resistance movements, belonging to a Party to the conflict and operating in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movements, fulfil the following conditions:

(a) That of being commanded by a person responsible for his subordinates;

(b) That of having a fixed distinctive sign recognizable at a distance;

(c) That of carrying arms openly;

(d) That of conducting their operations in accordance with the laws and customs of war.

3. Members of regular armed forces who profess allegiance to a government or an authority not recognized by the Detaining Power.

4. Persons who accompany the armed forces without actually being members thereof, such as civilian members of military aircraft crews, war correspondents, supply contractors, members of labour units or of services responsible for the welfare of the armed forces, provided that they have received authorization from the armed forces which they accompany, who shall provide them for that purpose with an identity card similar to the annexed model.

5. Members of crews, including masters, pilots and apprentices, of the merchant marine and the crews of civil aircraft of the Parties to the conflict, who do not benefit by more favourable treatment under any other provisions of international law.

6. Inhabitants of a non-occupied territory, who on the approach of the enemy spontaneously take up arms to resist the invading forces, without having had time to form themselves into regular armed units, provided they carry arms openly and respect the laws and customs of war.

B. The following shall likewise be treated as prisoners of war under the present Convention:

1. Persons belonging, or having belonged, to the armed forces of the occupied country, if the occupying Power considers it necessary by reason of such allegiance to intern them, even though it has originally liberated them while hostilities were going on outside the territory it occupies, in particular where such persons have made an unsuccessful attempt to rejoin the armed forces to which they belong and which are engaged in combat, or where they fail to comply with a summons made to them with a view to internment.

2. The persons belonging to one of the categories enumerated in the present Article, who have been received by neutral or non-belligerent Powers on their territory and whom these Powers are required to intern under international law, without prejudice to any more favourable treatment which these Powers may choose to give and with the exception of Articles 8, 10, 15, 30, fifth paragraph, 58-67, 92, 126 and, where diplomatic relations exist between the Parties to the conflict and the neutral or non-belligerent Power concerned, those Articles concerning the Protecting Power. Where such diplomatic relations exist, the Parties to a conflict on whom these persons depend shall be allowed to perform towards them the functions of a Protecting Power as provided in the present Convention, without prejudice to the functions which these Parties normally exercise in conformity with diplomatic and consular usage and treaties.

C. This Article shall in no way affect the status of medical personnel and chaplains as provided for in Article 33 of the present Convention.”

Russian diplomats are speculating that Senator Obama’s actions against the present US War Leaders in his country are due to the horrific testimony heard this past week in Washington where American soldiers detailed the war atrocities they have been ordered to commit, and as we can read as reported by the AntiWar News Service:

“Antiwar veterans of the U.S. wars in Iraq and Afghanistan took their case to Capitol Hill Thursday, baring their souls with stories of killings of innocent civilians, torture and wrongful detentions.

"On several occasions our convoys came upon bodies that had been lying on the road, sometimes for weeks," said Marine Corps veteran Vincent Emanuele, who served in al-Qaim near the Syrian border in 2004 and 2005.

"When encountering these bodies standard procedure was to run over the corpses, sometimes even stopping and taking pictures, which was also standard practice when encountering the dead in Iraq," he told the Congressional Progressive Caucus, which organized the hearing.

Emanuele also said that U.S. military personnel often took "pot shots" at cars passing by.

"Our rules of engagement stated that we should first fire warning shots into the ground in front of the car, then the engine block, and the windshield. That is if the car was even moving in the first place," he said. "Many times cars that actually had pulled off to the side of the road were also shot at."

Nine veterans of the Iraq war told their stories before members of Congress and a packed gallery. One of the veterans had also served in Afghanistan. About 40 veterans were in the audience.

The veterans spoke about extremely lax rules of engagement handed down by commanding officers, which they said virtually guaranteed atrocities would be committed, and which in turn created a violent backlash among Iraqi people and a continued cycle of violence.”

Russian experts in International Law further state in these reports that with this latest testimony by US war veterans of these atrocities, and when combined with the US torture of POW’s in their dreaded secret prisons spread around the Globe, there is ‘little doubt’ that the American War Leaders would be convicted of the War Crime charges leveled against them.

It should be noted that the United States refuses to call their captured enemies prisoners of war (POW’s) and instead designates them as ‘detainees’ and does not afford them their rights as granted under the Geneva Convention. Russian experts, however, noted that both Nazi Germany and the Japanese Empire had, likewise, used these terms for their POW’s, but when defeated by the Allied Forces in World War II they were brought to justice.

Further to be noted, and as we had previously reported on October 15, 2006, President Bush and his family have purchased nearly 100,000 acres of land in Paraguay for them to flee should War Crime Charges be filed against them.

Russian legal experts further state that Senator Obama, and should he, as expected, become the next President of the United States, he ‘almost certainly’ would have to file War Crime charges against these US War Leaders to keep himself from being brought up on these charges should he ignore them.

Benjamin Ferencz, the former chief prosecutor of the Nuremberg Trials against the Nazis, and who is the founding father of the basis behind International law regarding war crimes, has also stated that "There is a case for trying Bush for the supreme crime against humanity, and an illegal war of aggression against a sovereign nation."

To the success of a new President Obama being able to successfully prosecute America’s present War Leaders for their war crimes it is not too our knowing, but what is to our knowing is that the US Republican Party Leadership is now openly joking about his assassination, and as we can read as reported by the New York Daily News Service:

"Even a friendly National Rifle Association audience seemed stunned Friday after the former presidential candidate cracked a tasteless joke about a gun aimed at Barack Obama. Huckabee, a Republican and former Arkansas governor, was addressing the gun group's convention in Louisville, Ky., when a loud crash was heard off stage.

"That was Barack Obama," Huckabee ad-libbed. "He just tripped off a chair.... He's getting ready to speak, and somebody aimed a gun at him and he, he dove for the floor."

OBAMA BUSCA LA AYUDA DE LA CRUZ ROJA POR CRÍMENES DE GUERRA CONTRA BUSH, CHENEY, RUMSFELD

El Ministerio Ruso del Exterior el día de hoy informa al Presidente Medvedev
señalando que el candidato presidencial de los Estados Unidos, Barack Obama
ha enviado a uno de sus más importantes asistentes de nombre Valerie Jarrett
para reunirse con funcionarios del Comité Internacional de la Cruz Roja, en
Ginebra, Suiza, para lo que se está describiendo en estos informes como
"etapa preliminar" para iniciar acciones en la Corte Internacional de
Justicia acusando al actual Presidente de los Estados Unidos, a su
Vicepresidente y al ex Secretario de la Defensa por crímenes de guerra.

Como ya lo hemos detallado en nuestro informe del 15 de octubre de 2005, el
Comité Internacional de la Cruz Roja abrió en ese año un Portafolio de
Crímenes de Guerra argumentando que el Presidente Bush, el Vicepresidente
Cheney y el Secretario de la Defensa Rumsfeld, y otros funcionarios de ese
país, violaron los artículos 3 y 4 de la Convención de Ginebra y podrían ser
procesados por Crímenes contra la Humanidad.

Estos dos artículos de la Convención de Ginebra señalan que:

"Artículo 3

En caso de conflicto armado que no sea de carácter internacional que suceda
en el territorio de una de las altas partes contratantes, cada parte del
conflicto estará obligada a aplicar, como mínimo, las siguientes cláusulas:

1. Las personas que no tomen parte activa en las hostilidades, incluyendo a
los miembros de las fuerzas armadas que hayan depuesto sus armas y aquellos
puestos fuera de combate por enfermedad, heridas, detención o cualquier otra
causa, serán en todas las circunstancias tratados humanamente, sin ninguna
distinción adversa basada en la raza, color (de piel), religión o fe, sexo,
nacimiento o fortuna, o cualquier otro criterio similar.

Para este fin, los siguientes actos estarán y continuarán prohibidos en todo
momento y en todo lugar con respecto a las personas arriba mencionadas:

a) Violencia contra la vida y la persona, en particular asesinato de todo
tipo, mutilación, tratamiento cruel y tortura;

b) Toma de rehenes

c) Ultrajes a la dignidad personal, en particular, trato humillante y
degradante.

d) Aprobar sentencias y practicar ejecuciones sin previo juicio pronunciado
por una corte regularmente constituida proporcionando todas las garantías
judiciales que son reconocidas como indispensables por los pueblos
civilizados.

2.- Los heridos y los enfermos deberán ser recogidos y atendidos.

Un cuerpo humanitario imparcial, como el Comité Internacional de la Cruz
Roja, podría ofrecer sus servicios a las partes en conflicto.

Las partes del conflicto deberán empeñarse en cumplir, por medio de acuerdos
especiales, todas o parte de las otras cláusulas de la presente Convención.

La aplicación de las cláusulas precedentes no afectarán el status legal de
las partes en conflicto.

Artículo 4

A. Los prisioneros de guerra, en el sentido de la presente Convención, son
personas que pertenecen a una de las siguientes categorías, que han caído en
poder del enemigo:

1. Miembros de las fuerzas armadas de una parte del conflicto así como
miembros de las milicias o cuerpos de voluntarios que forman parte de dichas
fuerzas armadas.

2. Miembros de otras milicias o miembros de otros cuerpos de voluntarios,
incluyendo a aquellos de los movimientos de resistencia organizada, que
pertenecen a una de las partes en conflicto y operando dentro o fuera de su
propio territorio aún si este territorio está ocupado, siempre y cuando
tales milicias o cuerpos de voluntarios, incluyendo los dichos movimientos
de resistencia organizada, llenen las siguientes condiciones:

a) Ser comandados por una persona responsable por sus subordinados;
b) Traer un distintivo fijo reconocible a distancia;
c) Portar armas abiertamente;
d) Llevar a cabo sus operaciones de acuerdo con las leyes y prácticas de
guerra.

3. Los miembros de las fuerzas armadas regulares que protesten alianza a un
gobierno o a una autoridad no reconocida por el poder detentador.

4. Las personas que acompañan a las fuerzas armadas sin ser miembros, de
ahí, tales como civiles miembros de tripulaciones de aeronaves militares,
los corresponsales de guerra, los contratistas proveedores, los miembros de
unidades de trabajo o de servicios responsables del bienestar de las fuerzas
armadas, siempre y cuando hayan recibido autorización de las fuerzas armadas
que acompañan, quienes les proporcionarán para ese propósito una cédula de
identificación similar al modelo anexo.

5. Los miembros de tripulaciones, incluyendo maestres, pilotos y aprendices,
de la marina mercante y las tripulaciones de aeronaves civiles de las partes
en conflicto, que no se benefician por un tratamiento más favorable bajo
ninguna de las otras condiciones de las leyes internacionales.

6. Los habitantes de un territorio no-ocupado, que al acercamiento del
enemigo tomen las armas espontáneamente para resistir las fuerzas invasoras,
sin haber tenido tiempo de formarse ellos mismos en unidades armadas
regulares, siempre y cuando lleven armas abiertamente y respeten las leyes y
prácticas de la guerra.

B. Los siguientes de igual forma recibirán trato de prisioneros de guerra
bajo la presente Convención:

1. Las personas que pertenecen o hayan pertenecido, a las fuerzas armadas
del país ocupado, si el poder ocupante lo considera necesario por razones de
tal alianza internarlos, aun cuando originalmente los haya liberado mientras
se llevaban a cabo las hostilidades fuera del territorio que ocupa, en
particular donde tales personas hayan hecho un intento sin éxito de reunirse
a las fuerzas armadas a las que pertenecen o con las que están empeñadas en
combate, o donde no cumplan con los llamados hechos a ellos con vistas a un
internamiento.

2. Las personas que pertenezcan a una de las categorías enumeradas en el
presente artículo que hayan sido recibidos por potencias neutrales o no
beligerantes en su territorio y a quienes estas potencias requieran para
internarlos según las leyes internacionales, sin prejuicio de ningún
tratamiento más favorable que estas potencias elijan dar y con excepción de
los Artículos 8, 10, 15 y 30, quinto párrafo, 58-67, 92, 126 y, cuando
existan relaciones diplomáticas entre las partes en conflicto y en lo que
concierne al poder neutral o no beligerante, esos Artículos relacionados a
la potencia protectora. Cuando no existan dichas relaciones diplomáticas, a
las partes de un conflicto de quienes estas personas dependan, se les
permitirá realizar hacia ellas las funciones de potencia protectora como se
prevé en la presente Convención, sin prejuicio a las funciones que estas
partes normalmente ejercen en conformidad con el uso y tratados diplomáticos
y consulares.

C. Este Artículo de ningún modo afectará el status del personal médico y
capellanes como se prevé en el Artículo 33 de la presente Convención.

Los diplomáticos Rusos están especulando que las acciones del Senador Obama
contra los actuales jefes guerreros Estadounidenses en su país se deben al
espantoso testimonio escuchado la semana pasada en Washington donde los
soldados Estadounidenses detallaron las atrocidades de la guerra que se
ordenaron cometer y como lo informa el servicio noticioso Anti-War:

"Los Veteranos anti-guerra de las guerras Estadounidenses en Irak y
Afganistán llevaron su caso a Capitol Hill el jueves, desnudando sus almas
con narraciones de los asesinatos, torturas y detenciones indebidas de
civiles inocentes.

"En varias ocasiones nuestros convoyes llegaron con cuerpos que habían
estado yaciendo en los caminos, algunas veces durante semanas", dijo el
veterano del Cuerpo de Marinos, Vincent Emanuele, quien prestó sus servicios
en al-Qaim cerca de la frontera Siria en 2004 y 2005.

"Cuando se encontraban estos cuerpos el procedimiento standard era pasar los
vehículos por encima de los cadáveres, algunas veces detenerse y tomarles
fotos, que también es una práctica standard cuando se encuentran muertos en
Irak" les dijo al Comité Progresivo del Congreso, que organizó la audiencia.

Emanuele también dijo que el personal militar Estadounidense a menudo
disparaba "tiros al azar" a los automóviles que pasaban.

"Nuestras reglas de combate señalaban que primero deberíamos de hacer
disparos de advertencia al piso frente al automóvil, luego al bloque del
motor y al parabrisas. Eso si el automóvil continuaba avanzando en primer
lugar" dijo. "Muchas veces se les disparaba a los automóviles que se estaban
estacionando al lado del camino"

Nueve veteranos de la guerra de Irak contaron sus historias ante los
miembros del Congreso y a una galería atiborrada. Uno de los veteranos
también había prestado sus servicios en Afganistán. Alrededor de 40
veteranos estaban presentes en la audiencia.

Los veteranos hablaron sobre las extremadamente relajadas reglas de combate
que les dieron sus oficiales al mando, las que dijeron virtualmente
garantizaban las atrocidades que se cometieron, y que, a su vez, crearon un
violento contragolpe de parte del pueblo Irakí y un continuo ciclo de
violencia"

Los expertos Rusos en Derecho Internacional además señalan que en estos
informes con este reciente testimonio por parte de los veteranos de guerra
Estadounidenses de estas atrocidades, y que combinadas con la tortura de los
prisioneros de guerra en sus espantosas prisiones secretas esparcidas
alrededor del planeta, existe "poca duda" de que los jefes guerreros
Estadounidenses podrían ser condenados por las acusaciones de crímenes de
guerra levantadas en contra de ellos.

Debe de observarse que los Estados Unidos se niegan a llamar prisioneros de
guerra (POW) a sus enemigos capturados y mejor los designan como "detenidos"
y no les reconocen sus derechos concedidos bajo la Convención de Ginebra.
Sin embargo, los expertos Rusos, apuntaron que tanto la Alemania Nazi como
el Imperio Japonés, al igual, utilizaron estos términos para sus
prisioneros, pero cuando fueron derrotados por las Fuerzas Aliadas en la
Segunda Guerra Mundial, fueron llevados ante la justicia.

También se debe señalar, y como lo informamos el 15 de octubre de 2006, "El
Presidente Bush y su familia han comprado casi 100,000 acres de terreno en
Paraguay" para poder ellos huir si es que los cargos por crímenes de guerra
se entablan en su contra.

Los expertos jurídicos Rusos, señalan además que el Senador Obama, y si es
que, como se espera, se convierte en el próximo Presidente de los Estados
Unidos, "casi con seguridad" tendría que levantar los cargos por crímenes de
guerra contra estos jefes guerreros para evitarse él mismo ser acusado de
estos delitos si es que los ignora.

Benjamín Ferencz, el ex fiscal en jefe del Juicio de Nuremberg contra los
Nazis, y que es el padre fundador de la base del Derecho Internacional en lo
referente a crímenes de guerra, también apuntó que "Existen bases para
procesar a Bush por el delito supremo contra la humanidad y una guerra
ilegal de agresión contra un país soberano"

En cuanto al éxito que pueda tener el nuevo presidente Obama en llegar a
procesar a los actuales jefes guerreros de Estados Unidos, por sus crímenes
de guerra no lo sabemos, pero lo que sí sabemos es que el liderazgo del
partido Republicano está ahora abiertamente haciendo bromas sobre su
asesinato, y como lo informa el diario New York Daily:

"Hasta una amistosa audiencia de la Asociación Nacional del Rifle (National
Rifle Association) pareció impactada el viernes después de que el ex
candidato presidencial hiciera una desabrida broma sobre un arma apuntando a
Barack Obama. Huckabee, Republicano y ex gobernador de Arkansas, se estaba
dirigiendo a una convención del grupo de armas en Louisville, Kentucky,
cuando se escuchó un fuerte estruendo cerca del escenario.

"Ése fue Barack Obama" improvisó Huckabee. "Acaba de tropezarse con una
silla... Se está preparando para hablar y alguien apuntó un rifle hacia él y
él... él cándidamente voló hacia el piso"
